KENT, Ohio (Reuters) – A jury will decide whether former Kent State University student Timothy McVeigh will go free or spend the rest of his life in prison for the 2001 bombing of the federal building in Oklahoma City.

The 11-member jurors will hear an opening statement on Thursday morning. They will decide whether McVeigh was the lone killer behind the attack. They must also decide if he acted under the influence of “terrorist support material” or on instructions from his fellow defendants.

The prosecution and defense have two options to present to the jury: convict or find him Not Guilty, with one of the jurors choosing either.

McVeigh, a 28-year-old father of three, is accused of igniting a pipe bomb at the Alfred P. Murrah Federal Building with homemade materials and blowing it up on April 19, 1993, killing 168 people.

His attorneys have said he acted alone and were confident he would be acquitted. He is the youngest defendant to go to trial in the 1995 bombing that killed 168 people in a bombing the FBI blamed on Iraqi terrorists.

The trial has been dogged by questions about the state of McVeigh’s mental health, which doctors and experts have said could be a factor in his decision not to seek the death penalty.
