WASHINGTON (JTA) — The Supreme Court agreed on Wednesday to review the legal challenge by a California man to Proposition 187, banning gay marriage, by June 24.
The case is being argued in the U.S. Court of Appeals for the Ninth Circuit, with a hearing set for Nov. 17.
The Proposition 187 campaign, led by the group Freedom to Marry (FFM), argued that the U.S. Supreme Court had no jurisdiction to hear the case, the Los Angeles Times reported. They asserted that it would be better to leave the issue to be decided by the lower courts.
The state of California will argue that it has a right under the Constitution to enforce the ban on gay marriage in violation of its federal rights to equal protection and due process.
A ruling favorable to California could embolden other states to try passing laws they deem discriminatory against gay people.
Proposition 8, which banned gay marriage in California, was overturned in state courts that heard the Proponents’ appeal and in 2005.
In 2008 a federal district court decided the issue for California. The Obama administration is appealing it, arguing that the U.S. Constitution gives Congress the power to define marriage, not federal courts.
The U.S. High Court also heard arguments on the issue in 2006, ruling 5-4 that gay “marriage” should be permitted.
The United States Court of Appeals for the Second Circuit reversed that ruling two years later. The appeals court’s decision was later upheld by the U.S. Supreme Court in August 2011.
After both rulings, the justices stayed their decisions to allow for the two lower courts to consider Proposition 8’s constitutionality.
