TAMPA, Fla. (Reuters) – A Florida Republican has introduced legislation which would prohibit health care providers from inquiring about individuals’ medical histories if they have not personally witnessed the patient in question undergoing cancer treatment.

The Florida bill, the “I Wasn’t There and I Can’t Heal Act” was introduced by Representative Chris Smith, a member of the House of Representatives Committee on Energy and Commerce, this week. The text of the bill, provided on the committee’s website, can be found here: I-2-2016-001.
Smith, who serves on the Energy and Commerce Committee, has introduced legislation that would prevent any group health plan from asking the members of an insured family how much medical care they’ve done before in the past, what their primary doctor has ever prescribed them, or any other information.
The bill states that the information is not a valid medical record as defined under Florida Civil Practice Law, the official language of the state’s privacy laws.
