It’s not the first time that the FBI has asked Apple to help it crack a certain device, it certainly isn’t the last. But the agency’s request on Sunday was significant for a couple of reasons: It could have implications for the company’s ongoing fight against the company in Federal District Court in San Jose, Calif., over an alleged unlawful search and seizure in an iPhone.
The FBI is seeking access to an iPhone, which belonged to one of the San Bernardino shooters, and the iPhone itself is not one of the Apple products subject to the court’s order. Rather, Apple’s phone is just an iPod touch running iOS 6.1.2.
For the second time since the incident on Dec. 2, the FBI wants information about a device it believes to be involved in the shooting of 14 people at an office holiday party in San Bernardino. This is significant because when the FBI first said it would not negotiate with Apple, it was based on a finding (apparently made at the behest of law enforcement) that one of the shooters had a device with what the agency interpreted as an encrypted version of communications between his and girlfriend.
The device in question is a 2013 iPhone 5C running iOS 6.1.2 for the iPhone, and used by Syed Rizwan Farook, one of the shooters, to call his ex-wife and set up a meeting with the others with whom he was making plans and the couple’s two-year-old daughter. Farook sent some kind of signal via the device to a wireless Internet router on the couple’s property, which was subsequently linked to the San Bernardino apartment. That router was subsequently seized as evidence against Farook.
